New Fannie Mae Changes Prior to Closing

     Fannie Mae has implemented a new policy which will go into effect on June 1, lenders are responsible for certifying that the borrower's monthly obligations have not increased from the time of when credit was initially pulled through the closing date. This is effective for new conventional applications only and is not applicable for VA, FHA or Rural Development loans at this time but traditionally they will soon follow.
       The goal is to reduce the number of loans that default because of new, non-disclosed debt. Lenders have the freedom to verify in whatever manner they wish, but in most cases, the verification process will amount to a credit re-pull made just prior to closing. A credit report will be pulled at the beginning of the application and will also be pulled 5 days prior to closing.
       What does this mean for you, the borrower? It means that you absolutely should not take out any additional credit or even have an inquiry into your credit report from the time you start the loan application until after you close.
Tips to Avoid Last Minute Issues
DO NOT-
• Take out any new credit during your loan application – wait until your loan has closed
• This means no furniture shopping, new window treatments and especially no “Buy now –Pay later” type of financing
• Use your line-of-credit to purchase anything
• Make any large purchases using your credit cards
• Co-sign on a loan for anyone else
• Pay for the mover upfront – ask to be billed later
• Go car shopping even if not ready to buy yet – the dealer may pull your credit that will result in an additional inquiry
• Add to your current debt load as of application time until after closing
• Pay late on any obligation DO:
• Create paper trails for all deposits into your asset accounts
• Be prepared to write letters of explanations for anything out of the ordinary, e.g.: -For inquiries into your credit report – for any reason – over the last 90 days -For any derogatory credit issues -For any employment gaps
• Speak with your loan officer if you have any questions regarding any of this information

Good News:

Fewer Americans are falling behind on their mortgage payments; in fact, the fewest in two years. Mortgages just one payment past due (30 days) fell to their lowest level since just before the recession began. Is it delays in paperwork from the so called “robo-signing” (faulty paperwork) foreclosure servicing scandal? No. It’s actual fundamentals in the economy and the mortgage market. Go figure.
Bad News:

The biggest issue going forward is not new delinquencies, but the huge pipeline of loans already in the foreclosure process. It stands at 4.63 percent, tying the survey’s record high. This is due to foreclosure paperwork issues that have stalled the process, especially in the key state of Florida, where nearly one quarter of all mortgages are either delinquent or in foreclosure.

“With fewer loans exiting the foreclosure process through sales, the foreclosure inventory rate naturally increased, even as fewer foreclosure starts meant that fewer loans entered the foreclosure process in the fourth quarter,” says the MBA’s Michael Fratantoni.

As these foreclosures do make it through the process, and most will, they will put additional pressure on home prices, but for those of you with the long view, the drop in new delinquencies does present a glimmer of hope, perhaps a light at the end of the tunnel.

S&P Says Loan Mods Don’t Work

Standard & Poor’s Ratings Services reported in February that loan modifications are not working, saying most of these loans are in arrears within a year of being reset.
Its analysis found that 4 out of 5 modified notes that occurred from 2007 to 2010 were in default within two years. Borrowers made, on average 7.8 payments before falling behind again. S&P’s results came from analyzing more than 1 million non-agency residential mortgage-backed securities data provided by CoreLogic.
Because of these re-default numbers, the report concluded that loan modifications are really only a short-term solution. S&P actually believes principal reductions have a much better success rate. However, these only account for 3% of loan modifications.
The S&P report is just further evidence to document why the government should not step in to “help” with any more ideas or programs. Unpleasant as it is, we must let the system run its course.

Rents have surged as home prices have dropped, which have caused many to wonder if homeownership is really worth it. Moody’s Analytics data has suggested that it makes more financial sense to rent than buy in many U.S. cities, but Moody’s chief economist Mark Zandi now says that is about to change. "By mid 2011 and certainly by end of 2011, buying will be superior to renting in most parts of the country," Zandi says. 1. FHA Loans Are Not Only For Lower-Income Borrowers. FHA loans are available to everyone. In fact, even Bill Gates can get one. There is no maximum income restriction associated with FHA loans. Borrowers do need to substantiate income and assets by submitting proper documentation. This requirement ensures that borrowers are well-vetted and truly able to afford their future homes.

2. FHA Loans Are Not Only For First-Time Buyers. Many people believe FHA loans are available only to first-time homebuyers. This is not the case. Whether borrowers are making their first home purchase or their fifth, they can look to FHA loans as a home financing option.

3. FHA Loans Are Not Just Small Loans; In Fact, Loan Amounts Can Be As High As Almost $800,000. The government recently raised the maximum loan amount from its original cap of $362,790 to $793,750 as a way to help stabilize the housing market. The amount a buyer can borrow varies from county to county. Later this summer, condo buyers interested in FHA loans can visit www.checkfhaapproval.com to instantly identify FHA-approved condo associations and review maximum loan amounts for a given location.

4. FHA Loans Are Not Affiliated With The Section 8 Housing Program. While both programs are administered by the U.S. Department of Housing and Urban Development (HUD), FHA loans have nothing to do with low-income subsidized housing. FHA loans are simply mortgages insured by FHA. This insurance provided by the federal government allows lenders to lend more freely by assuring them that they will be repaid in the event of default. Most traditional lenders, including Wells Fargo & Co., JP Morgan Chase and Citigroup are able to provide FHA loans to their customers.

5. FHA Loans Are Often More Affordable Than Conventional Loans. While FHA loans typically offer the same interest rates as other loans, borrowers benefit from a much lower down payment of as low as 3.5 percent.

6. FHA-Approved Condo Developments Are More Desirable To Buyers. With 87 percent of home buyers indicating that they plan to use FHA loans, condo associations that are not FHA approved are missing out on a significant pool of prospective buyers. Under rules in place since February 2010, an entire condominium development must now apply to HUD and be granted FHA approval before a buyer can purchase a unit in an association with an FHA loan or before an existing unit owner can refinance into an FHA loan.

Due to the general unwillingness of today’s lenders to extend credit with respect to conventional loans, many borrowers find that FHA is their best bet. Lenders don’t mind lending when the federal government (FHA) assures them of repayment.

Homeowners associations (HOAs) should note that although FHA-insured mortgages might be easier to obtain, they are not “risky” loans, due in large part to the strict “full documentation” requirements placed on borrowers.

Individual buyers or sellers can initiate the approval process or current owners can encourage their HOA to apply. More information about the FHA- approval process is available at www.getfhaapproval.com.

7. FHA Loans Are Assumable. In addition to lower down-payment and credit-qualifying requirements as compared to conventional loans, FHA loans are assumable. This means that when a seller with an FHA loan sells his or her property, the loan and its financing terms (interest rate) can be transferred to the new buyer. This unique feature will certainly make a property more valuable in times of rising interest rates.

Fannie Mae and Freddie Mac are freezing all foreclosure evictions on the mortgage loans they own or back from Dec. 20 through Jan. 3.

"If the property is occupied, our foreclosure attorneys will suspend the eviction to provide a greater measure of certainty to families during the holidays," says Anthony Renzi, executive vice president of single family portfolio management at Freddie Mac.

Most of the large banks, including Bank of America, J.P. Morgan Chase, and Wells Fargo, already observe a moratorium through the New Year, unless the foreclosure involves an investor who chooses not to observe the holiday policy.

Market Update

The housing market continues its gradual recovery without the aid of the tax credit. Sales are slower but growing. Although it will likely be uneven at times, slow growth is believed to be the trend moving forward. Interest rates hit a new historic low again, a major factor in helping keep mortgage payments incredibly affordable.

Extended periods of record low interest rates and further plans from the Federal Reserve Board to expedite recovery have some concerned about future inflation. One such investment guru, John Paulson, touted the benefits of owning real estate as a hedge against inflation on Forbes.com. “Your debt and interest payments get locked in at record lows, while the price of your home will rise … If you don’t own a home buy one … if you own one home, buy another one, and if you own two homes, buy a third and lend your relatives the money to buy a home.”

This march back up continues to provide excellent opportunities: an ample selection of homes, affordable prices, and historically low interest rates. Experts anticipate both the economy and the housing market will continue their paths on the way to a complete recovery.

Home Sales

Home sales continued to rebound in September, increasing 10% compared to the previous month. This builds on August’s gain of 7.6% that followed a large drop caused by the expiration of the federal tax credit in July. Sales are expected to gradually grow as the market moves toward recovery without government stimulus. The recent foreclosure moratorium has opened up opportunities for short sales. Although it could make the near-term “choppy at times,” industry experts expect the overall trend to continue growing slowly.

Home Price

After four months of prices remaining on par with year-ago levels, September showed a slight decline. Last September distressed properties were 29% of all home sales; this September that number rose to 35%. The larger proportion of distressed sales, which are typically discounted, helps to explain the decline. While these discounted sales provide opportunities for buyers, sellers look forward to the general trending upward of home price.

Inventory

There are fewer homes on the market again in September, representing 10.7 months of inventory. While still at a relatively high level, months of inventory shrank by nearly a month in September from August’s 11.6 and nearly two months since the 12.5-month supply in July. This continues to represent an excellent opportunity for buyers and investors who have not yet taken advantage of the abundant opportunities of the market including record low rates, an ample but shrinking selection of homes, and highly affordable prices.

Affordability

Housing remains at near-record affordability levels, and prospective home buyers stand to benefit from the lowest mortgage rates in decades, as well as advantageous home prices. Housing is approximately 60% more affordable now than during the height of the market.

Interest Rates

Mortgage rates once again set new record lows in early October to 4.19% and remained below 4.3% throughout the month. These historically low rates contributed to real savings for buyers. Furthermore, the longer the buyer owns the home, the greater the savings they will realize. As economic activity gains momentum, rates will rise to keep inflation at an acceptable level.

Recent history has reframed some of what had long been taken for granted about buying a home. Namely, we’ve learned that even though buying a home remains one of the best and safest investments available, a home should not function as an ATM or a short-term speculation strategy. So, where does that leave us? A lot smarter, able to recognize an opportunity when we see one, and aware of the facts that point to now as the prime time to buy a home.

1.Home affordability is at an all-time high. The median mortgage payment on the median-priced home, as a percentage of the median household income, is lower than it’s been in a generation.

3.Home prices are back on the rise. After declining for 30 months, home prices are trending back upward. The time to get in the market is now.

5.Financing is readily available. Banks are back in the game and ready to lend to well-qualified buyers.
6.Owning vs. renting is increasingly favorable. Since 2009, the average principal and interest payment has fallen below the average rental rates, and the gap is now wider than it’s been in the past 22 years.
7.Homeownership is still at the core of the American Dream. Owning a home is critical to financial stability and wealth building. It’s a forced savings account, a place to live, and a fabulous tax deduction.

Can't Just Eat One- Oreo Truffles

Here is a little something sweet and delicious for the upcoming holidays.
Oreo Truffles
1 8oz. package of softened cream cheese, 1 stick of melted butter, 1 package of regular oreos, crushed 2 blocks of white chocolate almond bark. Blend together first three ingredients for about 3 minutes, for a smooth mixture. Chill for one hour. Roll into bite size balls and then dunk in melted almond bark chocolate. Let cool on wax paper. Then cool again (I usually put them in the refrigerator over night and they are ready to go the next day.) Hint: Don't over heat the chocolate--it won't work then. Just put in for 1.5 min and then stir and then put in for 30 sec. intervals until smooth.

CRAVAACK CALLS ON OBERSTAR TO RESIGN AS HEAD OF HOUSE TRANSPORTATION COMMITTEE

ST. PAUL -- Congressional candidate Chip Cravaack today called on Rep. James Oberstar to resign as chairman of the House Transportation and Infrastructure Committee because he has failed to take any useful action in the two months since an oil well began to poison the Gulf of Mexico.

“During the worst environmental disaster in American history, Jim Oberstar has been asleep at the helm of the House Transportation committee,” Cravaack, a graduate of the United States Naval Academy, said. “No skipper has been so slow to act since Joe Hazelwood was sleeping it off in his bunk during the Exxon Valdez crash in 1989. It is time for Jim Oberstar to step down as chairman of the House Transportation and Infrastructure Committee.”

Oberstar is chair of the committee which oversees the Coast Guard and is responsible for federal management of emergencies and oil pollution of navigable waters, including inland, costal, and ocean waters.

“Not only has Congressman Oberstar failed to protect America’s coastline, he has obstructed cleanup efforts that could have saved hundreds of American jobs in the fishing and tourism industries. “

Cravaack called to light the fact that Oberstar has had two months to formulate a plan to deal with the cleanup of the spill. Not only have Oberstar and his committee failed to come up with a plan, they have made the situation worse by holding up vital equipment and machinery from getting to the affected areas.

Cravaack then asked citizens to go to his website at http://www.votechip.org and share their ideas with him.

“We need leadership, action and results now. It is time for new vision and a new work ethic in Congress,” Cravaack said. “It is time for Congressman Oberstar to step down and time for America to work together to find common sense solutions.

Home Appraisals- What to Expect

The appraiser will need approximately 30 minutes to one hour to complete the inspection phase of the appraisal process, which includes: exterior photos of the front and rear of the home and a photo of the street in front of the property; measurements of the exterior of the home, garage and any outbuildings; a walk-through inspection of all rooms and levels of the interior of the home including the basement.
Get organized. Put together a checklist that will help you get ready for your appraisal and get the results you're looking for.
Be flexible when scheduling the appointment.
Have a copy of your home’s blueprint to help verify measurements and lot size.
Provide a list of improvements made to the property since the purchase. Improvements that should be noted include adding a pool, patio, updating your kitchen or bathroom and any room additions, etc.
Allow your appraiser access to the entire property, including access to any crawl space or attic areas.
Keep in mind that a clean home makes a good impression. Be sure to trim the lawn, clean the pool and garage, repair cracked windows or torn screens, check for leaky faucets and secure gutters and down spouts before your appraisal.
Point out any amenities that may not be obvious to the appraiser: sprinkler systems, patios, pools, security systems, built in vacuum, etc.
Provide a copy of last year's tax assessment information.
Know what year the house was built and when improvements were made.
The first thing appraisers look for is comparables, so be prepared and have a list of recent sales of similar properties in the immediate neighborhood.

Can You Prevent
Internet Scams such as others stealing listings and posting them as rentals?
It would be nice but you probably can not. This is very common on the Internet now days.

One scam you may not have heard of involves stealing a listing's for sale information and photos and then the thieves run ads that the house is for rent.
They run the ads on free websites like Craigslist. Their hope is that someone out of state might be ignorant enough to send a deposit and the first month's rent without ever having seen the property. Then they take the money and then they run away laughing.
This has happened to homes listed in the Brainerd Lakes area several times.
Be aware, be alert- do not send money to strangers and work with a professional!

"So speak ye, and so do, as they that shall be judged by the law of liberty." (James 2:12)

On Independence Day, Americans should give thanks to the Author of liberty that we have been privileged to live in this "sweet land of liberty," where we can worship God freely, in accord with His Word. Liberty is not license, however, and the essence of the American system is liberty under law. Fundamentally, that law is "the law of nature and of nature's God"--the natural laws of God's world and the revealed laws of God's Word. Within that framework we do have liberty--but not liberty to defy either the physical law of gravity or the spiritual "law of liberty." The latter is formulated in Scripture and has been applied over the centuries, in the English common law and later in our system of constitutional law, both of which are based on Scripture.

Some today, seeking license rather than liberty, might recoil at the very idea of "the law of liberty," calling it an "oxymoron," or contradiction in terms. But Jesus said that only "the truth shall make you free!" (John 8:32). "Sin is the transgression of the law" (1 John 3:4), and "sin, when it is finished, bringeth forth death" (James 1:15), not freedom!

No one can be saved by the law, but those who are saved--by grace through faith in Christ--will love God's law, for it is "holy, and just, and good" (Romans 7:12). We should say with the psalmist: "So shall I keep thy law continually for ever and ever. And I will walk at liberty: for I seek thy precepts" (Psalm 119:44-45).

There is, indeed, a law of liberty, and whoever will walk in real liberty will find it only in God's law of life, through His revealed Word. For "whoso looketh into the perfect law of liberty, and continueth therein, he being not a forgetful hearer, but a doer of the work, this man shall be blessed in his deed" (James 1:25). HMM

May Homebuyer Traffic Tumbled

Homebuyer traffic nationwide tumbled in May, according to the latest
Campbell/Inside Mortgage Finance Monthly Survey of Real Estate Market Conditions. Most of the decline was attributable to first-time homebuyers who sharply reduced their home shopping last month.
The survey's first-time homebuyer traffic index, which measures home shopping activity on a scale of 1 to 100, registered an anemic 35.1 in May. This was down from an index of 63.5 in April. Since September 2009, the index had never been below 50, which represents a flat, or neutral, condition in home purchase activity.
“The decline of first-time homebuyer traffic is undoubtedly related to the expiration of the federal homebuyer tax credit,” stated Thomas Popik, research director for Campbell Surveys. “Homebuyers had until April 30 to sign a purchase and sale agreement and receive the credit. Once we entered the month of May, the government stimulus disappeared.”

FHA Loan Misconceptions Addressed

RISMEDIA, July 1, 2010--FHA Pros, LLC, a national FHA condo approval service, has developed a list of facts speaking to the top misconceptions associated with FHA loans in order to help home buyers better navigate an already confusing market. FHA loans are mortgages issued by qualified lenders and insured by the Federal Housing Administration (FHA).

“We have seen home buyer interest in FHA loans go from practically zero three years ago to upwards of 87 percent today,” said Christopher Gardner, founder and president of FHA Pros, LLC. “Despite this rapid rise in popularity, many buyers still do not fully understand the benefits of these loans, and we believe it’s time to change that.”

1. FHA Loans Are Not Only For Lower-Income Borrowers. FHA loans are available to everyone. In fact, even Bill Gates can get one. There is no maximum income restriction associated with FHA loans. Borrowers do need to substantiate income and assets by submitting proper documentation. This requirement ensures that borrowers are well-vetted and truly able to afford their future homes.

2. FHA Loans Are Not Only For First-Time Buyers. Many people believe FHA loans are available only to first-time homebuyers. This is not the case. Whether borrowers are making their first home purchase or their fifth, they can look to FHA loans as a home financing option.

3. FHA Loans Are Not Just Small Loans; In Fact, Loan Amounts Can Be As High As Almost $800,000. The government recently raised the maximum loan amount from its original cap of $362,790 to $793,750 as a way to help stabilize the housing market. The amount a buyer can borrow varies from county to county. Later this summer, condo buyers interested in FHA loans can visit www.checkfhaapproval.com to instantly identify FHA-approved condo associations and review maximum loan amounts for a given location.

4. FHA Loans Are Not Affiliated With The Section 8 Housing Program. While both programs are administered by the U.S. Department of Housing and Urban Development (HUD), FHA loans have nothing to do with low-income subsidized housing. FHA loans are simply mortgages insured by FHA. This insurance provided by the federal government allows lenders to lend more freely by assuring them that they will be repaid in the event of default. Most traditional lenders, including Wells Fargo & Co., JP Morgan Chase and Citigroup are able to provide FHA loans to their customers.

5. FHA Loans Are Often More Affordable Than Conventional Loans. While FHA loans typically offer the same interest rates as other loans, borrowers benefit from a much lower down payment of as low as 3.5 percent.

6. FHA-Approved Condo Developments Are More Desirable To Buyers. With 87 percent of home buyers indicating that they plan to use FHA loans, condo associations that are not FHA approved are missing out on a significant pool of prospective buyers. Under rules in place since February 2010, an entire condominium development must now apply to HUD and be granted FHA approval before a buyer can purchase a unit in an association with an FHA loan or before an existing unit owner can refinance into an FHA loan.

Due to the general unwillingness of today’s lenders to extend credit with respect to conventional loans, many borrowers find that FHA is their best bet. Lenders don’t mind lending when the federal government (FHA) assures them of repayment.

Homeowners associations (HOAs) should note that although FHA-insured mortgages might be easier to obtain, they are not “risky” loans, due in large part to the strict “full documentation” requirements placed on borrowers.

Individual buyers or sellers can initiate the approval process or current owners can encourage their HOA to apply. More information about the FHA- approval process is available at www.getfhaapproval.com.

7. FHA Loans Are Assumable. In addition to lower down-payment and credit-qualifying requirements as compared to conventional loans, FHA loans are assumable. This means that when a seller with an FHA loan sells his or her property, the loan and its financing terms (interest rate) can be transferred to the new buyer. This unique feature will certainly make a property more valuable in times of rising interest rates.

Fielding a Lowball Purchase Offer on Your Home

Consider before you ignore or outright refuse a very low purchase offer for your home. A counteroffer and negotiation could turn that low purchase offer into a sale.
You just received a purchase offer from someone who wants to buy your home. You’re excited and relieved, until you realize the purchase offer is much lower than your asking price. How should you respond? Set aside your emotions, focus on the facts, and prepare a counteroffer that keeps the buyers involved in the deal.

Check your emotions

A purchase offer, even a very low one, means someone wants to purchase your home. Unless the offer is laughably low, it deserves a cordial response, whether that’s a counteroffer or an outright rejection. Remain calm and discuss with your real estate agent the many ways you can respond to a lowball purchase offer.

Counter the purchase offer

Unless you’ve received multiple purchase offers, the best response is to counter the low offer with a price and terms you’re willing to accept. Some buyers make a low offer because they think that’s customary, they’re afraid they’ll overpay, or they want to test your limits.

A counteroffer signals that you’re willing to negotiate. One strategy for your counteroffer is to lower your price, but remove any concessions such as seller assistance with closing costs, or features such as kitchen appliances that you’d like to take with you.

Consider the terms

Price is paramount for most buyers and sellers, but it’s not the only deal point. A low purchase offer might make sense if the contingencies are reasonable, the closing date meets your needs, and the buyer is preapproved for a mortgage. Consider what terms you might change in a counteroffer to make the deal work.

Review your comps

Ask your REALTOR® whether any homes that are comparable to yours (known as “comps”) have been sold or put on the market since your home was listed for sale. If those new comps are at lower prices, you might have to lower your price to match them if you want to sell.

Consider the buyer’s comps

Buyers sometimes attach comps to a low offer to try to convince the seller to accept a lower purchase offer. Take a look at those comps. Are the homes similar to yours? If so, your asking price might be unrealistic. If not, you might want to include in your counteroffer information about those homes and your own comps that justify your asking price.

If the buyers don’t include comps to justify their low purchase offer, have your real estate agent ask the buyers’ agent for those comps.

Get the agents together

If the purchase offer is too low to counter, but you don’t have a better option, ask your real estate agent to call the buyer’s agent and try to narrow the price gap so that a counteroffer would make sense. Also, ask your real estate agent whether the buyer (or buyer’s agent) has a reputation for lowball purchase offers. If that’s the case, you might feel freer to reject the offer.

Don’t signal desperation

Buyers are sensitive to signs that a seller may be receptive to a low purchase offer. If your home is vacant or your home’s listing describes you as a “motivated” seller, you’re signaling you’re open to a low offer.

If you can remedy the situation, maybe by renting furniture or asking your agent not to mention in your home listing that you’re motivated, the next purchase offer you get might be more to your liking.

Saving Money in the Kitchen

Spending less money on utility bills doesn’t mean you need to rush out and purchase a whole new suite of Energy Star appliances. With occasional light maintenance and good habits, you can greatly improve the energy efficiency of your large kitchen appliances—up to about $120 annually—without sacrificing convenience.

Refrigerator/freezer

Energy-efficiency experts tell us to focus our efforts on the biggest energy hogs in the house, and that definitely includes the fridge. Because it cycles on and off all day, every day, the refrigerator consumes more electricity than nearly every appliance in the home save for the HVAC systems. The average refrigerator costs about $90 per year to operate, according to the U.S. Department of Energy. The good news is that a few simple adjustments can trim roughly $38 to $45 off those utility bills.
1. Adjust the thermostat. By setting the thermostat colder than it needs to be, you might increase your fridge’s energy consumption by as much as 25% on average. Adjust the refrigerator so that it stays in the 37-40 degrees F range. For the freezer, shoot for between 0-5 degrees F. You could save up to $22 per year. If your model doesn’t display the current temps, invest in two appliance thermometers (one for the fridge, one for the freezer). They cost roughly $3-$20 apiece at online retailers.
2. Clean the coils. As dust accumulates on the condenser coils on the rear or bottom of the fridge, it restricts cool-air flow and forces the unit to work harder and longer than necessary. Every six months, vacuum away the dust that accumulates on the mechanism. Also, check to see that there is at least a 3-inch clearance at the rear of the fridge for proper ventilation. This routine maintenance can trim up to 5% off the unit’s operating cost, says energy savings expert Michael Bluejay, saving you about $4.50 a year.
3. Use an ice tray. Automatic ice makers are a nice convenience, to be sure, but it turns out the mechanisms are energy hogs. An automatic ice maker can increase a refrigerator’s energy consumption by 14% to 20%, according to Energy Star. By switching off the ice maker and using trays, you can save about $12 to $18 off your annual electricity bill. Most units require little more than a lift of the sensor arm to switch them off. To reclaim the space remove the entire unit, a simple DIY job on many models.
4. Unplug the “beer fridge.” Many homes have an extra fridge that runs year round even though it’s used sparingly. Worse, these fridges tend to be older, more inefficient models. By consolidating the contents to the main fridge and unplugging the additional unit, you eliminate the entire operating cost of a fridge. The second-best solution is to make sure the extra fridge remains three-quarters full at all times. The mass helps maintain steady internal temps and lets the fridge recover more quickly after the door is opened and closed, according to the California Energy Commission.

Ovens and ranges

“Green” cooking all comes down to proper time and space management. By using gas and electric stoves more effectively, you can painlessly save a few dollars a year.
5. Cut the power early. As anybody who’s ever bumped a burner on an electric stove can attest, those heating elements stay hot long after they’ve been switched off. Put that residual heat to work by shutting off the burner several minutes before the end of the cook time. The same technique can be applied to the oven. The savings can add up to a couple bucks every month.
6. Match the burner to pan. When a small pan is placed on a big burner you can practically see the money disappearing into thin air. By matching the burner to the pan, electricity won’t be squandered heating the kitchen rather than the food. The reverse is true, too. A small burner will take considerably longer to heat a large pan than would an appropriately sized burner. For gas stoves, don’t let the flames lick the sides of the pot. Follow these tips and watch the utility bills shrink by a few dollars a month.
7. Do away with preheating. You can save about $2 a month by not preheating your oven (20 cents per hour to operate electric oven; eliminate 20 30-minute preheats a month). Many cooks agree that the practice is wholly unnecessary for all but a few recipes, namely baking breads and cakes. This approach may add a few minutes to the overall cooking time, but it eliminates all that wait time on the front end.

As with washing machines, most of a dishwasher’s energy needs go to heating the water. Still, says Lane Burt, an energy policy analyst with The Natural Resources Defense Council, a 10-year-old dishwasher can be made nearly as efficient as a newer model simply by knowing when and how to run it. Follow a few simple tips, and you can reduce your annual utility costs by roughly $35-$54.
8. Manage the load. Most dishwashers use the same amount of water and energy whether they’re run full or half-full. You can cut your operating costs by one-third or one-half by running the machine only when it’s full. It costs about $54 to run a pre-2000 model dishwasher per year, based on government data. Proper load management can save up to $27 each year.
9. Activate energy-saving features. A dishwasher’s heated dry cycle can add 15% to 50% to the appliance’s operating cost. Most machines allow the feature to be switched off (or not turned on), which can save $8-$27 per year, assuming an operating cost of $54 annually. If your dishwasher doesn’t have that flexibility, simply turn the appliance off after the final rinse and open the door.
10. Use the machine. Many homeowners believe they can save water and energy by hand washing dishes. The truth is that a dishwasher requires less than one-third the water it would take to do those same dishes in the sink. By running the machine (when full), you can cut down the operating time of the hot water heater, your home’s largest energy hog. Not only will you save a buck per month, you won’t have to do the dishes.

"Mortgage lenders are apparently being swamped by the demand for homebuyers to close on their home loan by June 30th, which is the current expiration date of the home buyer tax credit. Therefore, the U.S. Senate has voted for a proposal that would extend the tax credit again.

Usually, it wouldn't take over two months to close on a home loan. But, it's not normal circumstances right now. In today's world of mortgage finance, every bit of the home buyers information has to be verified and reverified and the home valuation code of conduct is also having to be adhered to by appraisers. Therefore, it's taking much longer to close and time gets stretched out.

According to the National Association of Realtors®, there are 180,000 buyers who made the April 30th deadline to have their valid contracts signed. However, without another tax extension, many would not make the last deadline to close by June 30th.

So, through the new proposal, if you have signed a valid contract before April 30th, you will be eligible for the home buyers tax credit extension."

Dangerous Listing Strategies in a Short Sale

The growth of short sales (i.e. circumstance where mortgage debt exceeds the fair market value of the house and necessitates the lender discounting the mortgage to effectuate a sale) has reached epidemic portions in Minnesota and throughout the country. As a result, real estate agents are dealing on a regular basis with the myriad of problems associated with short sales.

One of the more frustrating aspects of implementing a short sale involves identifying and opening a dialogue with the appropriate representative of the lender in an effort to discuss, negotiate and ultimately secure a discount on the mortgage balance sufficient to effectuate a sale. Between the frustration of talking to voicemail, other than a live body, and the complex bureaucracy of most lenders, connecting with the “right person” within the lender bureaucracy is challenging and frustrating.

A variety of imaginative techniques have been developed in trying to implement a short sale and overcome the challenges of connecting with the right person in the lender bureaucracy. One technique that is becoming more common is the listing agent for the short sale seller prepares a bogus purchase agreement on behalf of a bogus buyer or a buyer who has no intention of going forward with the transaction. The seller signs the purchase agreement and the agent then submits it to the lender. The purchase agreement is then assigned to a lender’s negotiator, at which time the agent withdraws the offer so it is never approved or considered by the lender. The strategy behind this technique is that the purchase agreement gets the attention of the “right person” in the proper department within the lender bureaucracy and is the catalyst for opening a dialogue on short sale terms.

The problem with this technique/strategy is that it is fraudulent, that is, the submission of such a purchase agreement constitutes a misrepresentation to the lender that this is a valid purchase agreement submitted by an interested buyer when in fact it is not.

In pursuing this strategy, there are potential adverse consequences to the listing agent on the following three fronts:

1. Department of Commerce: To the extent a competitor, the lender, the seller or any other interested party files a complaint with the Department of Commerce against the listing agent, that agent runs the risk of Department of Commerce sanctions for fraudulent, deceptive and dishonest practices. Sanctions can include fines up to $10,000 per violation, suspension of license, or revocation of license.

2. National Association of REALTORS® Code of Ethics: Article 1 of the National Association of REALTORS® (NAR) Code f Ethics requires a REALTOR® to “protect and promote the interests of their client” and “to treat all parties honestly.” Article 2 states that a “REALTOR® shall avoid exaggeration, misrepresentation or concealment of pertinent facts relation to the property or transaction.” The technique/strategy described in this article may well be deemed by a professional standards hearing panel in violation of one or both of these code sections. Sanctions could include fines up to $5,000 per violation, suspension or revocation of membership in the association and therefore lack of access to MLS.

3. Lawsuits: Someone adversely affected by the technique/strategy described in this article, such as the seller or the lender, could commence a lawsuit against the listing agent and his company for fraud/misrepresentation seeking recovery of damages arising our the fraudulent activity of the agent. While the frustrations of implementing a short sale are real, real estate agents are cautioned against the use of the technique/strategy described in this article.

We all know that staging a home for sale means turning it into a product that will appeal to the largest cross-section of potential buyers out there. However, stagers are well-advised to bear in mind the likely demographic of potential buyers for a given property. RISMEDIA, May 15, 2010—The world of video can be a scary beast when you first start. Where do you begin? How long should the video be? What should it cover? The key is to use what you already have.

Here are four key tips, courtesy of VScreen’s Stephen Schweickart:

(1) Don’t reinvent the wheel. Many firms have well-established marketing plans that may have taken considerable time and effort to implement. Show the boss how you can take what you are currently doing…and do it better with video. The addition of video can be all about enhancement of existing strategies… and reaching goals more quickly and effectively.

(2) Take small steps. Perhaps your current marketing plan makes use of written testimonials. Consider expanding their impact by filming a few of them. After all, enthusiasm is contagious…and what better way to share emotion than with video? Another beginning strategy might be to consider producing a 60-second “About Us” video for your website to replace the written version. It’s a great way to add a human dimension to your company.

(3) Don’t break the bank. In a challenging economy…every penny counts. But it’s also a catch 22. While you may be able to save some money by doing some of it yourself…first impressions are critical. Doing something poorly may be worse than doing nothing at all…especially if your competition hires professionals. The compromise is simple…control costs by being conservative with both the length and quantity of videos produced. Start with just one or two…and negotiate for an introductory rate. Remember, having even one video is far better than having none at all.

(4) Leverage the advantages. Recent studies have shown that when done correctly, videos with proper tags are up to 53 times more likely to generate a first page Google ranking when compared with traditional SEO techniques. Studies also demonstrate that video is preferred over text by a 6 to 1 margin, and is growing online at a rate of 40% a year. And with over 80% of all US Internet users now watching online video, it’s no wonder!

And finally, don’t forget what you already know. Print media, when used properly, is still a powerful and viable means of marketing. The key is to integrate video with print in a complementary fashion.

“The Possible Origin of My Career...” by Lori Matzke
When I turned five, my parents bought me a dollhouse. It was a large English manor- style home made out of vinyl that opened and closed like a suitcase. The exterior was imprinted with a red tile roof, white bricks, and numerous windows adorned with lush boxes spilling over with bright pink geraniums and trailing vines. Once the top buckle was unfastened, the lid would fall open to reveal a marble terrace that lead to a grand foyer and even grander rooms within.
My parents included furnishings and a complete mini- nuclear family, including Mom and Dad, Junior and Sissy. And while I truly appreciated having a nice family to occupy such a terrific home, I rarely played with them. To be honest, I was much more interested in the space and furnishings. And who wouldn’t be? The house was quite phenomenal in my little world
and occupied many endless hours as I quietly arranged and rearranged the furnishings, key word here being 'quietly', which I can only assume was my parent’s original intent.
But I soon found there were certainly limitations to my designs, as the store bought furnishings didn’t quite fill up the house. So I had to learn quickly to reinvent everyday items to make it comfortable.
My grandmother’s many spools of colorful thread were easily converted into patio seating while her box of buttons offered a variety of plates to set the table for dining or pasted on the walls for decoration, in a pinch. With my mother’s highly trained skills (I was too young to wield a scissors on my own, at the time) tissue boxes were cut down to build a refrigerator, cabinets, and stove, outfitted with handles, knobs, and burners using my super-size crayons and a little
bit of chewing gum.
As you can only imagine, the possibilities were endless. And the ease of maintenance on the house was nothing short of amazing! With very little effort, my mother could simply flip out the furnishings, take the entire house out on the lawn, and hose it down completely, ridding the brick, terrace, and walls of any trace of peanut butter smudges or Popsicle drips that might have been left by the manor’s own in-house designer and resident snacker.
It occurred to me that this was perhaps the first house I ever staged. Though I have yet to find another home or owner so easy to accommodate, nor anywhere near as easy to maintain, I am convinced that early on I was already honing my craft and working towards a fulfilling career in home staging. Who knew?

Fixing a big hole in the wall

1. For fist-size holes or bigger, cut a square piece of Sheetrock slightly larger than the hole. Enlarge the hole so this patch will fit by placing the piece over the hole, tracing its outline, and cutting the wall along your marks with a utility knife.
2. Cut two pieces of small scrap wood a few inches longer than the width of the hole — these will be the backing for the patch. Put one piece of wood in the hole, hooking it with your fingers to hold it flat against the back of the existing wall. The wood will span the hole, parallel to and about an inch from its edge. With drywall screws, screw each end through the drywall into the wood. Repeat with the other wood scrap at the opposite edge of the hole.
3. Now lay the Sheetrock patch in the opening and screw it to the wood. Cover the seams with mesh dry-wall tape. Apply a first coat of joint compound (like Spackle) with a putty knife over the mesh. For a smooth finish, apply thin, wide coats, not one thick layer. Let dry overnight. Apply two more coats, and let each dry overnight, sanding smooth between applications. Sponge away dust, and paint to match the wall.

A woman came home from work late, tired and irritated, to find her 5-year old son waiting for her at the door.
SON: 'Mummy, may I ask you a question?'
MUM: 'Yeah sure, what it is?' replied the woman.
SON: 'Mummy, how much do you make an hour?'
MUM: 'That's none of your business. Why do you ask such a thing?' the woman said angrily.
SON: 'I just want to know. Please tell me, how much do you make an hour?'
MUM: 'If you must know, I make $20 an hour.'
SON: 'Oh,' the little boy replied, with his head down.
SON: "Mummy, may I please borrow $5?"
The mother was furious, 'If the only reason you asked that is so you can borrow some money to buy a silly toy.
The little boy quietly went to his room and shut
the door..
The woman sat down and started to think.
Maybe there was something he really needed to buy with that $5 and he really didn't ask for money very often.The woman went to the door of the little boy's room and opened the door.
'Are you asleep, son?' She asked.
'No Mummy, I'm awake,' replied the boy.
'I've been thinking, maybe I was too hard on you earlier' said the woman. 'It's been a long day and I took out my aggravation on you. Here's the $5 you asked for.'
The little boy sat straight up, smiling. 'Oh, thank you Mummy!' he yelled. Then, reaching under his pillow he pulled out some crumpled up bills.
The woman saw that the boy already had money.
The little boy slowly counted out his money, and then looked up at his mother.
'Why do you want more money if you already have some?' the mother grumbled.
'Because I didn't have enough, but now I do,' the little boy replied.

RISMEDIA, February 22, 2010—As a first-time home buyer, Jessica Garcia was excited last April to officially begin her home search. She found a home within her price range, completed the lengthy paperwork and paid for the appraisals, only to later be told after four months that the deal would not close.
Out of luck and out of money, Garcia was frustrated, but not defeated. She went back to her Realtor to start the search again. It was then that she found the home she would later purchase. Upon first glance, Garcia liked the home and saw its potential, but didn’t have the upfront money it would take to rehab the home the way it needed to be done.
     After some discussion, Garcia’s lender, Kevin Roy with Wells Fargo, realized that she might be able to take advantage of HUD’s 203k program, specifically designed to rehabilitate and repair single-family homes. The 203k is a single mortgage loan that provides funds to purchase a home and make repairs and improvements.
      “The home needed a lot of work,” explains Garcia, of North Port, Florida. “The previous owners had pets that had really torn up the carpeting and destroyed the blinds.”
      Indeed, the home needed new flooring, carpets and, most importantly, a water softener for its wellwater system. So, when the opportunity arose to take advantage of the 203k program, Garcia was game.
     “In the end, it worked out great,” she says. “The credit goes to Kevin because if he hadn’t told me about the 203k program, I would not have had the money to fix the home. All of the money I had was put into the appraisals and fees for the first home that I couldn’t close on.”

Closing Costs Checklist

The cost of buying a property goes beyond simply paying the price negotiated between the buyer and seller.
If you pay cash, you will probably pay less and close faster. If you are taking on a mortgage, the closing costs involved to complete the transaction can range from 2% to 7% of the purchase price.

Fees required vary by state. Here are some of the common fees included in a typical settlement, which will comprise your closing costs:
Fees related to a mortgage loan (if you are borrowing to buy):

    * Loan origination fee
    * Loan discount ("points") - a one-time fee charged by the lender to lower your monthly interest rate
    * Appraisal fee* (the lender usually orders an appraisal to determine the value of the property)
    * Credit Report fee* (for the lender to research your credit rating)

Here are a few things home buyers can do to ensure that they get the most from an agent.

Get pre-approved. I shouldn't have to explain this. The housing industry has been bent like a pipe cleaner the past 18 months. A pre approval older than 90 days is worthless, and no pre-approval disqualifies you from being taken seriously by a seller. . It takes 10 minutes to speak with a lender and get a free updated pre-approval that shows you are ready, willing and able buyers.
Practice monogamy. Often in New York, some buyers think that they can get a batter deal if they work with more than 1 agent or deal directly with listing agents. Both of these notions are not only false, they can be expensive mistakes. If your agent catches on to the fact that you are playing the field, he'll start hedging his bets also, because nobody wants to devote time to a buyer file that might not close because you are looking in another town with another broker.
Figure out what you want. Some agents get understandably frustrated when they spend a Sunday morning looking at town homes and Tuesday evening walking through Victorian colonials with the same buyer. I can almost intuit what some buyers want after spending time with them. However, if you are too whimsical, I might get the sense that we're just unlocking doors so you can satisfy curiosity.
Return our calls. Sound familiar? Do you like it when you can't reach an agent for 3 days? It is the same here. Buyers who drop out and resurface without explanation are deemed unreliable and risky. It is only fair; stay in touch.
Take our advice. The reason I give people 3 lawyers, 3 home inspectors, and 3 mortgage firms is not because I get a kickback, it is because I know that your union attorney won't return calls, an Internet bank can screw you, and your uncle Mel is not a licensed home inspector. I cannot compensate for their deficiencies. I am more effective with a cooperative team.
Sign a buyer representation agreement. This tells the agent "you are hired. We won't use anyone else." You risk nothing by doing this, because if someone is hired, they can be fired if they stink. Establish performance criteria, have a 3 strikes and out rule or reasonable exit clause, and the agent is now at your service.

Doing these things will make you hold your agent to a higher standard, and ensure that you get the most from them. Never forget that agents are human, just like you. An agent assured that they have a qualified, sincere, eager client can work confidently for that client. If they take you for granted, that can be grounds for firing them. With that leverage, everybody wins.

Home sales in the Greater Lakes region in January were once again up compared to a year ago at 93 closed sales, an increase of 34.8 percent from a year ago. That's the fifth consecutive month where the change compared to a year ago has been positive. The increase in sales has led to stabilizing home prices. January's median sales price of $124,405 was 1.4 percent higher than a year ago. Yes, rising prices are ordinarily a pretty ho-hum and normal thing, but in light of the drop in prices that most parts of the country have seen over the last several years, 'ho-hum' is a welcome phrase these days. The Months Supply of Inventory in the region has decreased in the last year to 17.3, down 7.8 percent from the mark of 18.7 seen a year ago. That's still a very high mark, which means sellers still face challenging conditions that require smart pricing and marketing.

The January 2010 Twin Cities housing market has shaped up to be nearly identical to January 2009.

* Pending sales are down slightly from a year ago, but not by much.
* New listings are down slightly from a year ago, but not much.
* Inventory is rising slowly, but not much.

After the roller coaster ride the local market has experienced over the last four years, perhaps "not by much" is a welcome respite.

* There were 558 signed purchase agreements for the week ending January 23, down 2.3 percent from a year ago.
* New listings posted 1,522 units, down 0.6 percent from a year ago.
* The current inventory of active listings is 20,629, down 17.5 percent from a year ago.

The February 2010 Supply-Demand Ratio sits at 6.99, which means there are 6.99 homes available for each buyer. That's a drop of 8.5 percent from a year ago and the lowest February mark since 2006.

After years of upsizing, Americans are enjoying the benefits of more modest living spaces.

With the average home size declining, owners are cleverly doing more with the square footage they have.

Years before house staging came into vogue as a sales tool, Howard Hoffman was helping sellers rearrange their furniture to maximize floor space and enhance a home’s beauty. Hoffman, GRI, SRES®, now owns Stage & $ell, a home staging and redesign company in Indianapolis.

Chances are he’ll have a lot more business in the years ahead from people needing to resize their lives. With baby boomers entering retirement, young adults delaying marriage, and the economy improving by fits and starts, Americans are starting to embrace the idea that less is more when it comes to their square footage. The average size of a new house decreased last year for the first time in nearly three decades.

"Home buyers have been changing," says Fran Litton, a planner with Evans Group, an architectural firm in Orlando, Fla. "They still want the luxury and toys, but they’re putting them into a smaller space."

Although the average square footage of a new house is still double what it was in 1960, in the last year, it decreased slightly to 2,215 square feet from a high of 2,277 square feet in 2008, according to data from the U.S. Census Bureau. While the decrease doesn’t approach mid-20th century levels, it is the first drop in house size since the recession of the early 1980s.

Smaller houses can mean bigger challenges for real estate professionals. "Eighty percent of people appreciate only what they can see," says Hoffman, who also works as a sales associate with F.C. Tucker Co. in Indianapolis. "You have to make sure you’re showing them what you’ve got." That means making sure each room is easily identified. "Get rid of that desk and computer in the dining room," he says. "Make sure buyers can see it’s a dining room."

Hoffman also advises clients to remove rugs to show off hardwood floors and take pictures off the walls. "The less the eye has to distract it, the bigger a room feels," says Hoffman. "People buy what they see. If they can’t see the floors or the walls, they won’t buy the house."

Interior designer Roberta Lathrop agrees. She tells her clients with smaller kitchens to clear the counters. "You can’t have all the small appliances sitting on the counter," says Lathrop, who runs Designs by Roberta in Belmont, Mich. "It will start looking very cluttered very fast."

Smaller houses require owners to rethink what they have and how they use things. "If you have a smaller house, maybe you don’t need half a dozen different pans," she explains. "Maybe a single flat griddle that you can put over a couple of burners will do."

Mature-Market Home Buyers Look beyond Buildings, Desire Services

RISMEDIA, January 27, 2010—A survey of consumers and builders, conducted in 2009 by the National Association of Home Builders (NAHB) and the MetLife Mature Market Institute, has yielded a new round of data revealing the housing preferences of the 55+ consumer. This analysis of data–the third in a series–compared the preferences of the 55-to-64 year old age group to those of the 65+ group.

The data uncovered a strong similarity in housing preferences between the two groups, with a few exceptions. The younger age group showed more interest in technology-heavy features, while the older group expressed a stronger preference for a single-story floor plan or one with a first-floor master bedroom, and a variety of universal design features.

One striking difference, according to John Migliaccio, director of research at MetLife's Mature Market Institute, related to the desire for home services and community services. "Very telling, said Migliaccio, "is that the younger group of mature consumers reported enthusiastically that they want services like home maintenance and repair as part of their next home purchase, along with services typically connected to older homeowners, such as housekeeping, onsite health care and transportation," noted Migliaccio.

According to Migliaccio, all of the aforementioned were ranked higher than the desire for organized social activities–a surprise, inasmuch as social activities and amenities have been thought to be valued quite highly by this group. This finding, he said, supports an emerging trend among builders to look for ways to partner with providers of such services to the residents of their active adult/lifestyle communities.

According to Mike McGowan, a 50+ builder from Binghamton, N.Y. and chair of NAHB's 50+ Housing Council, "Most buyers in this market are looking for an easy-living lifestyle. They would like access to services that will free up their time from maintenance both inside and outside their homes. This data tells builders that the homes we build for older active adults will remain attractive to the consumers who will be entering that market for the foreseeable future."

Paul Emrath, NAHB's vice president for survey and housing policy research, pointed out that the share of households that will want lower-maintenance housing is large, and growing larger as Baby Boomers age into that segment of the market. He cautioned that the current financial situation has led to sharply decreased construction of communities that serve the mature market. Without a change in the availability of capital for development and construction, there could well be a shortage of such housing when it is most needed.

How do Interest Rates Affect Ability to Buy?

First, take a look at what happens to monthly payments when interest rates go up. When interest rates go from 5 to 10% what happens?

A 5% 30 year $100k mortgage will cost $536.82 monthly
A 6% 30 year $100k mortgage will cost $599.55 monthly
A 7% 30 year $100k mortgage will cost $665.30 monthly
A 10% 30 year $100k mortgage will cost $877.57 monthly
That is NOT including taxes, insurance, or anything but the mortgage itself.

As far as buying ability is concerned :compared to a 5% interest rate a 6% interest rate drops the effective buying ability by 10% and a 7% interest rate drops buying ability by about 24%.
There is a very large amount of buying ability taken away by a small 2% increase in interest rates.

RISMEDIA, January 7, 2010—As we begin 2010, both real estate professionals and home buyers have something to look forward to and more importantly, take advantage of—the extended and expanded home buyer tax credit.
Originally created in 2008, the home-buyer tax credit has evolved from a $7,500 credit, which had to be repaid by the home buyer over the course of 15 years, to an $8,000 tax credit with no repayment required in 2009. Now, for a limited time in 2010, the $8,000 home buyer tax credit will still be available to first-time home buyers and certain current homeowners will also be eligible for a $6,500 credit.
To help everyone better understand the extended and expanded home buyer tax credit, here are some highlights of the changes.
Who can claim the credit?
“First-time home buyers” who purchase homes between November 7, 2009 and April 30, 2010 are eligible for the credit. To qualify as a “first-time home buyer” the purchaser or his/her spouse may not have owned a residence during the three years prior to the purchase.
For current homeowners purchasing a home during the same time frame, they are also eligible for a tax credit, so long as the home being sold or vacated was their principal residence for five consecutive years within the last eight. To elaborate, it must be the same home; it is not enough that they have been homeowners for five consecutive years, they must have been in the same home for five consecutive years.
Another key point is that the existing home does not need to be sold. One must, however, occupy the new home as a principal residence and do so for three years or risk recapture of the credit. Also, the new home does not need to cost more than the old home despite the concept that it is directed at “move up” buyers.
How much is the credit and what are the income limits?
The maximum allowable credit for first-time home buyers is $8,000 or 10% of the sales price, whichever is less. For current homeowners, it is $6,500 or 10% of the sale price, whichever is less. Under the extended home buyer tax credit, single buyers with incomes up to $125,000 and married couples with incomes up to $225,000 may receive the maximum credit.
The credit decreases for single buyers who earn between $125,000 and $145,000 and between $225,000 and $245,000 for home buyers filing jointly. The amount of the tax credit deceases as his/her income approaches the maximum limit. Home buyers earning more than the maximum qualifying income – over $145,000 for singles and over $245,000 for couples – are not eligible for the credit.
What are the deadlines for qualifying for the credit?
Under the extended home buyer tax credit, as long as a written binding contract to purchase a home is in effect on April 30, 2010, and the deal is closed by July 1, 2010, one can claim the credit.
Will the tax credit need to be repaid?
No, the buyer does not need to repay the tax credit if he/she occupies the home for three years or more. However, if the property is sold during this three-year period, the full amount of the credit will be recouped on the sale. Another provision of the law waives the recapture provisions for service members who receive orders that require them to move.
Are there any other critical provisions?
-There are three provisions people should be aware of:
-There is an $800,000 limitation on the cost of the home
-The purchaser must be at least 18 years old on the date of purchase
-For a married couple, only one spouse must meet this age requirement and dependents are not eligible to claim the credit
Finally, as an anti-fraud measure, purchasers must attach documentation of purchase to his/her tax return claiming the credit. Normally this would be a copy of the HUD-1, but could include other documents memorializing the settlement.
As with all tax matters, responsibility for complying with the tax code belongs to the taxpayer. Real estate professionals should recommend that their buyers consult their tax professionals to ensure eligibility for the credit and the proper way to claim the credit. * To be eligible to claim the tax credit, buyers must have owned and lived in their previous home for five consecutive years out of the last eight years.

Washington Report: New Consumer Financial Protection Agency

Congress took a major step last week toward eliminating what has been a painful thorn in the side of home sellers, Realtors, home builders, mortgage brokers and appraisers for months.

As part of its financial and mortgage industry reform bill, the House voted to terminate the controversial Home Valuation Code of Conduct (HVCC) once a new Consumer Financial Protection Agency begins operations.

The new agency would assume primary federal responsibility for equal opportunity in credit, real estate settlement procedures, financial disclosures to borrowers, plus unfair and deceptive marketing in mortgages and other financial products.

The giant bill, nearly 1,300 pages long, now heads to the Senate, which is working on its own version.

But tucked away in the depths of the House bill is a section that provides unusually detailed instructions to the director of the new Consumer Protection agency. The legislation requires the director to quickly come with new national appraisal rules and standards covering all transactions.

On the day the new rules are adopted, Fannie and Freddie will be prohibited from using their much-maligned home valuation code.

Fannie's and Freddie's rules have been criticized for producing lowball, inaccurate valuations; cutting appraisers' fees to the point where the most experienced professionals refuse to accept low-pay assignments; plus encouraging the use of inexperienced appraisers unfamiliar with local markets - and a long list of other problems.

The National Association of Realtors and the National Association of Home Builders have fought the code since it was first imposed last spring. Mortgage brokers and appraisers have circulated petitions asking Congress to ban it or impose a moratorium. One petition reportedly pulled in more than 100,000 signatures.

Now the House is on record as favoring the code's termination.

Under the legislation, the consumer agency's rules would require lenders to compensate appraisers their full fees, rather than splitting them with management companies and pocketing part of the money themselves.

It would also allow mortgage brokers and loan officers who are state licensed and registered under the federal “SAFE” law to order valuations and discuss them with appraisers, which they are not allowed to do under the Fannie-Freddie code.

The bill also permits home sellers, buyers and Realtors to ask appraisers to consider alternative market data and comparables without such requests being treated as “interference.”

Whether the Senate ultimately goes along with creation of the consumer protection agency won't be know until next year.

But the House bill should be a warning shot to Fannie and Freddie that their controversial appraisal code may have a very limited lifespan.

Twin Cities Housing Market Report for 12-09

The last week of 2009 found the Twin Cities housing market singing "Auld Lang Syne" and taking a breather. For the first time in four years, the active listing inventory dropped below 20,000. Chiming in the New Year at 18,980, inventory is at its lowest point since April 2005 and is 22 percent below last year at this time. Also of note, January's Supply-Demand Ratio of 6.69 houses per buyer is 20.6 percent behind a year ago.
New listings for the week ending December 26 dropped 18.9 percent from last year to 446. The 392 purchase agreements for the week were up a merry 53.1 percent above the previous year; while a significant jump, this reflects a small sample size.
We expect 2010 to begin slowly as car starting becomes more important than house hunting during the frigid conditions we're presently experiencing in the metro area.

A lavish presentation witnessed by Dubai’s ruler and thousands of onlookers at the base of the tower said the building was 828 meters, or 2717 feet, tall. Dubai is opening the tower in the midst of a deep financial crisis. Its oil rich neighbor Abu Dhabi has pumped billions of dollars in bailout funds into the emirate as it struggles to pay its debts.

Let’s hope Emaar does better at high rises in its own neighborhood than it did on investing in U.S. real estate. Emaar lost $1.6 billion buying Orange County homebuilder John Laing in 2006 — at the peak of the American housing boom. Laing is being liquidated in bankruptcy court.
Says the Financial Times of Emaar …

The developer has been hurt by the property market collapse locally and internationally, but the region’s largest builder is less bruised than its peers. Although it too invested abroad in a problematic acquisition of John Laing Homes, the US homebuilder, Emaar has developed a reputation for quality delivery and has a manageable debt profile. Most analysts believe the residents moving into the Burj Dubai apartments from February are not speculators who will struggle to make their final 30 per cent payments. Prices in the tower, which hit a peak when Armani-styled residences were sold in 2007, have not been subject to the same pressures as elsewhere in Dubai.

The Obama administration’s $75 billion program to protect homeowners from foreclosure has been widely pronounced a disappointment, and some economists and real estate experts now contend it has done more harm than good.

Since President Obama announced the program in February, it has lowered mortgage payments on a trial basis for hundreds of thousands of people but has largely failed to provide permanent relief.

Critics increasingly argue that the program, Making Home Affordable, has raised false hopes among people who simply cannot afford their homes.

As a result, desperate homeowners have sent payments to banks in often-futile efforts to keep their homes, which some see as wasting dollars they could have saved in preparation for moving to cheaper rental residences.

Some borrowers have seen their credit tarnished while falsely assuming that loan modifications involved no negative reports to credit agencies.

Some experts argue the program has impeded economic recovery by delaying a wrenching yet cleansing process through which borrowers give up unaffordable homes and banks fully reckon with their disastrous bets on real estate, enabling money to flow more freely through the financial system.

“The choice we appear to be making is trying to modify our way out of this, which has the effect of lengthening the crisis,” said Kevin Katari, managing member of Watershed Asset Management, a San Francisco-based hedge fund. “We have simply slowed the foreclosure pipeline, with people staying in houses they are ultimately not going to be able to afford anyway.”

Mr. Katari contends that banks have been using temporary loan modifications under the Obama plan as justification to avoid an honest accounting of the mortgage losses still on their books.

Only after banks are forced to acknowledge losses and the real estate market absorbs a now pent-up surge of foreclosed properties will housing prices drop to levels at which enough Americans can afford to buy, he argues.

“Then the carpenters can go back to work,” Mr. Katari said. “The roofers can go back to work, and we start building housing again. If this drips out over the next few years, that whole sector of the economy isn’t going to recover.”

The Treasury Department publicly maintains that its program is on track.

“The program is meeting its intended goal of providing immediate relief to homeowners across the country,” a department spokeswoman, Meg Reilly, wrote in an e-mail message.

But behind the scenes, Treasury officials appear to have concluded that growing numbers of delinquent borrowers simply lack enough income to afford their homes and must be eased out.

In late November, with scant public disclosure, the Treasury Department started the Foreclosure Alternatives Program, through which it will encourage arrangements that result in distressed borrowers surrendering their homes.

The program will pay incentives to mortgage companies that allow homeowners to sell properties for less than they owe on their mortgages — short sales, in real estate parlance. The government will also pay incentives to mortgage companies that allow delinquent borrowers to hand over their deeds in lieu of foreclosing.

Ms. Reilly, the Treasury spokeswoman, said the foreclosure alternatives program did not represent a new policy.

“We have said from the start that modifications will not be the solution for all homeowners and will not solve the housing crisis alone,” Ms. Reilly said by e-mail. “This has always been a multi-pronged effort.”
